MADIGAN: SETTLMENT REQUIRES LASALLE TIRE DEALER TO FOLLOW STORAGE AND DISPOSAL LAW

Chicago − Attorney General Lisa Madigan today announced an agreement with a LaSalle tire dealer that requires him to comply with an order to follow the law regarding the storage and disposal of used and waste tires and regulations designed to limit conditions that can lead to the spread of the West Nile virus during warm weather months.

The settlement, entered yesterday, January 26, in LaSalle County Circuit Court, resolves Madigan’s May 2005 lawsuit filed against Greg Prey individually, and as owner of King Tire, 237 1 st St., in LaSalle.

Madigan’s suit alleged, among other violations, that Prey failed to follow the terms of a previous Illinois Pollution Control Board (IPCB) order regarding the storage and transportation of used and waste tires. In addition, Prey allegedly failed to pay the annual registration fee required by the Illinois Environmental Protection Agency (IEPA) for tire storage sites, allowed tires that were intended for recycling to accumulate for more than 90 days and failed to safeguard the tires against collecting water.

The IEPA referred the case to Madigan’s office. Under the agreement, Prey is required to pay a civil penalty of $10,000 upon entry of the agreement with the court. Prey does not admit wrongdoing in the agreement.
